1. Acceptance of Terms

By accessing or using Altered Stories ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Description of Service

Altered Stories is a print-on-demand platform that allows users to create custom t-shirt designs using AI-powered image generation tools. We provide the technology and fulfillment services; users provide the creative direction through text prompts and reference images.

3. AI-Generated Content Disclosure

By using our AI design tools, you acknowledge and agree that:

• AI-generated designs may lack copyright protection under applicable law
• Third parties may legally reproduce unprotected AI-generated content
• You are solely responsible for verifying the legality and originality of AI outputs before commercialization
• We make no representations about the copyrightability of AI-generated content

4. User Responsibilities

You are solely responsible for all content you create, generate, or submit through the Platform. You represent and warrant that:

• You have all necessary rights to use any images you upload as reference material
• Your content does not infringe any third-party intellectual property rights, including copyrights and trademarks
• Your content does not violate any applicable laws or regulations
• You will not use our services to create content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable

5. Prohibited Content

You may not use our services to create content that:

• Infringes on copyrights, trademarks, or other intellectual property rights
• Contains hate speech or promotes discrimination
• Depicts violence, gore, or illegal activities
• Contains sexually explicit material
• Impersonates real individuals without authorization
• Violates any applicable laws or regulations

We reserve the right to remove any content that violates these terms and to terminate accounts of repeat offenders.

6. Indemnification

You agree to indemnify, defend, and hold harmless Altered Stories, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with:

• Your access to or use of the Platform
• Your violation of these Terms
• Your violation of any third-party rights, including intellectual property rights
• Any content you create, submit, or generate through our services

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALTERED STORIES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use or inability to use our services
• Any unauthorized access to or use of our servers
• Any third-party claims related to your content
• Any errors or omissions in our services

Our total liability shall not exceed the amount you paid to us in the twelve (12) months preceding the claim, or $100, whichever is greater.

8. Disclaimer of Warranties

THE PLATFORM AND ALL SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that our services will be uninterrupted, error-free, or secure, or that any defects will be corrected.

9. Intellectual Property

The Altered Stories name, logo, and all related marks are trademarks of Altered Stories. Our platform software, design, and underlying technology are protected by intellectual property laws.

You retain any rights you may have in content you create, subject to the limitations regarding AI-generated content described in Section 3.

10. DMCA Compliance

We respect intellectual property rights and comply with the Digital Millennium Copyright Act (DMCA). For copyright infringement claims, please see our DMCA Policy.

11. Termination

We may terminate or suspend your access to our services at any time, with or without cause, with or without notice. Upon termination, your right to use our services will immediately cease.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law provisions.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by updating the "Last updated" date. Your continued use of our services after changes constitutes acceptance of the modified Terms.
